POLICE ARE CRACKING DOWN ON PEOPLE LIVING IN VEHICLES!


In the wake of the opening of the night-time only “Safe Lot” at H Barracks (2209 Kinkaid Road), San Diego police have begun cracking down on people who live in their RVs, campers, or trailers under the Oversized Vehicle Ordinance (OVO). The police are focusing on ticketing those living at Mission Bay. The OVO prohibits nighttime parking of oversized vehicles anywhere in the city from 2 to 6 a.m. It is distinguished from ticketing for violation of signs for parking from 2 to 4 and other parking tickets.


The City has also threatened criminal enforcement of the Vehicle Habitation Ordinance prohibiting living in one’s vehicle. Enforcement of both ordinances is restricted under the settlement in Bloom et al. vs. City of San Diego. VHO enforcement can only occur if there is reasonable suspicion of a crime or other law violation separate from living in your vehicle, regardless of if there is an available spot at a “Safe Lot”.




YOUR RIGHTS UNDER THE SETTLEMENT REGARDING OVO ENFORCEMENT

  1. 1. You can check the existence of available parking spots for oversized vehicles by checking the City’s website at:
    https://www.sandiego.gov/homelessness-strategies-and-solutions/services/safe-parking-program

  2. 2. You can only be ticketed if a parking spot at a “Safe lot” is reasonably available to you considering size of your vehicle, distance to the lot and other factors.
    For example, if your vehicle can fit into an empty parking spot at H Barracks but you cannot afford to pay for gas and wear and tear on your vehicle going back and forth on a daily basis from the lot to where you usually park during the day, and there is no free daytime parking for your oversized vehicle available closer to the lot, that spot may not be deemed available to you.

  3. 3. You have the right to be given an opportunity to relocate to a Safe Lot prior to being ticketed.
    If you are not sure whether the space the police are offering is reasonably available to you, it may make sense to go to the lot when the police request it and check it out or take the initiative and apply with Jewish Family Services by calling 858-637-3373. The other Safe Lot that accepts oversized vehicles is in Mission Valley and is open 24 hours but is usually full. You can put yourself on the waiting list.

  4. 4. You have a right to request reasonable accommodation or an exception to enforcement based on your disability.

  5. 5. Please Note: the deadline to submit claims for ticket forgiveness has passed.
